General Terms and Conditions
§ 1 Scope of application
For your online orders of goods via our SAEBEL homepage, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. Any provisions deviating from these terms and conditions shall only apply if they have been confirmed by us in writing.

§ 2 Conclusion of contract
Our information on goods and prices within the ordering process is subject to change and non-binding. By clicking on the order button, the customer makes a binding declaration to the supplier that he wishes to purchase the goods listed.
§ 3 Right of withdrawal and right of return
You have a right of withdrawal and a right of return (§ 355 of the German Civil Code). Thereafter, you can withdraw from a contract concluded in accordance with these GTC without giving any reasons within a period of two weeks after proper delivery. For this purpose, it is sufficient to return the goods, but also a written declaration from you or a declaration embodied on another durable medium. The timely dispatch of the goods or the declaration to the above address of SAEBEL GmbH is sufficient to meet the deadline. You must also return the goods to us in the event of a mere declaration of revocation. We reserve the right to take further action if these goods are used or damaged. Custom-made products or items that cannot be resold are excluded from returns.
§ 5 Due date and payment, retention of title
The purchase price is due for deliveries as prepayment or invoice, delivery will be made as soon as possible thereafter.
The delivered goods remain our property until full payment has been made.
§ 6 Claims for defects and warranty
The product illustrations may not always fully correspond to the appearance of the delivered products. The defined RAL color tones apply particularly to the colors. Depending on the material and surface, deviations from RAL color sample cards may occur. Claims for defects do not exist insofar as the changes are reasonable for the customer.
The customer is obliged to check the goods received immediately for obvious defects. If he discovers obvious defects, he must inform the supplier immediately. If he fails to do so, he cannot assert any warranty claims against the supplier due to these defects.
The provider is not liable for defects caused by the customer. This also applies to normal wear and tear. The exercise of the right of withdrawal by the customer remains unaffected.
In the event of a defect in the goods, the supplier is entitled to choose between subsequent delivery or rectification. If the rectification of defects finally fails or if the subsequently delivered goods are also defective, the customer may demand the return of the goods against reimbursement of the agreed price or a reduction of the purchase price.
§ 7 Deviating conditions of the customer
In the event that the customer uses his own general terms and conditions that deviate from the content of these general terms and conditions, the general terms and conditions of the provider shall apply exclusively.
§ 8 Miscellaneous
(1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
